Terms and Conditions

These Terms and Conditions (hereinafter «Terms») govern access to and use of the LocalPatron platform, published by Fabrice Dal Maso, self-employed (Autónomo), Tax ID: Z0414929Z, Calle Zurbaran 22, 03187 Los Montesinos, Alicante, Spain (hereinafter «LocalPatron»).

By creating an account, you unconditionally accept these Terms in their current version.

1. Service Description

LocalPatron is a SaaS platform enabling professionals to manage their online reputation on Google Business Profile. The Service includes:

• AI-generated response suggestions for Google reviews.
• Local SEO optimization of responses.
• Publication of responses after mandatory 4-step human validation — no automatic publication without explicit user action.
• Google Business Profile audit.
• AI-assisted generation of photos, posts, and service descriptions.
• Drip-Feed Scheduler: schedule Google posts at +15, +30, +45 or +60 minutes, with a push reminder notification. No publication takes place without explicit user validation.
• Intelligent post recycling: automated monthly rewriting of Google posts older than 6 months, always generated as a draft for explicit user validation before any publication.
• Local SEO support tools: citation checker across 10+ local directories per market (FR/ES/EN), PDF QR code generation for review collection, automatic public holiday alerts, Google Maps keyword rank tracker, strategic benchmark vs competitors, and contextual intelligence based on the establishment profile (sector and activity level).
• Suspicious review detection, toxicity analysis, and Google reporting assistance.
• PWA push notifications and multi-establishment management via Workspaces with role-based access control (Admin / Manager / Viewer).
• Email support. "Priority support" (Business and Agency plans) means requests are processed before those from Free, Starter, and Pro plans. This does not constitute a guaranteed response time or a 24/7 support service. "Dedicated" (Agency plan) means a separate communication channel, not an exclusively assigned agent.

2. Access to the Service

The Service is reserved for adult individuals acting professionally (business owners, agencies, freelancers) or legal entities.

To prevent abuse of free trial periods, LocalPatron retains a normalised record of email addresses that have already benefited from a free trial. This retention is based on legitimate interest (art. 6.1.f GDPR) and is detailed in the Privacy Policy.

3. Plans and Pricing

Prices shown exclude taxes for businesses with a valid VAT number. Applicable VAT is displayed at checkout via Stripe. For users without a valid intra-Community VAT number, the VAT rate of the user's country of residence applies in accordance with EU One-Stop-Shop (OSS) rules. Subscriptions are monthly, no commitment, cancellable at any time from account settings. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for unused time. A seasonal pause of 1 to 3 months is available at no charge.

At the end of the 7-day free trial, the account automatically switches to the Free plan (3 responses/month, 1 establishment) at no charge. No action is required from the user.

As this Service is directed exclusively at professionals (B2B), consumer withdrawal rights do not apply. For reference: for EU-based users, this refers to the right under EU Directive 2011/83/EU art. 16(a); for UK-based users, the equivalent exclusion applies under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, reg. 36(1)(a).

Founder Offer

LocalPatron offers a €5/month discount (the "Founder Offer") to the first 100 subscribers of a paid plan. This offer is: valid as long as the subscription remains active and uninterrupted (cancellation followed by a new subscription does not reactivate it); applicable to all paid plans and maintained when changing plans; non-transferable and personal; subject to prices in effect at the time of the initial subscription. The term "forever" used in marketing communications means the uninterrupted duration of the user's subscription, not an unconditional perpetual commitment.

The seasonal pause is a contractually provided feature and does not constitute an interruption for the purposes of the Founder Offer: the €5/month discount is maintained upon resumption. Available once per calendar year, to be activated from account settings before the next billing date.

4. User Obligations

• Comply with Google's terms of use, particularly rules relating to Google Business Profile review responses.
• Do not publish unlawful content: defamatory, discriminatory, or threatening responses.
• Validate each response before publishing: you are solely responsible for content published under your name on Google.
• Do not use the Service for illegal purposes: review manipulation, fraud, or any unlawful activity.

5. Google Business Profile Connection and Official API

5.1 OAuth 2.0 Authentication

To publish responses on your Google listing, LocalPatron uses the official Google Business Profile API via OAuth 2.0. The permission scope requested is limited to: https://www.googleapis.com/auth/business.manage.

AI content generation is provided by Groq Inc. (model llama-3.3-70b-versatile, primary provider), Anthropic PBC (models claude-haiku-4-5-20251001 and claude-sonnet-4-6, automatic failover and specialised tasks) and Google LLC (Gemini 2.0 Flash, visual image analysis, multilingual translation and review fraud detection). None of these providers train their models on transmitted data.

5.2 Full Human Control — Mandatory Validation Before Any Publication

1. Step 1 — Generation: Click «Generate a response». Nothing is published.
2. Step 2 — Content validation: Read the response, edit if needed, save as draft.
3. Step 3 — Confirmation: Click «Publish to Google». A confirmation screen appears.
4. Step 4 — Effective publication: You confirm. Only then is the Google API called.

LocalPatron never publishes automatically on your behalf.

5.3 Access Revocation

• From LocalPatron: Settings → Google Business Profile → Disconnect
• From Google: myaccount.google.com/permissions → LocalPatron → Remove access

5.4 Google Policy Compliance

LocalPatron's use of information received through Google APIs complies with the Google API Services User Data Policy, including Limited Use requirements. See developers.google.com/terms/api-services-user-data-policy.

5.5 Transparency on AI-generated content (EU AI Act — art. 50)

In accordance with Article 50 of the EU Artificial Intelligence Act (Regulation (EU) 2024/1689), LocalPatron informs its users that response suggestions, photo descriptions, posts and service descriptions are generated by artificial intelligence systems. This content is labelled as such in the interface before any human validation. The user retains full control and is solely responsible for the content they choose to publish.

5.6 Technical delivery delay

In certain cases, effective publication on Google Business Profile may be delayed by a few minutes (maximum 30 minutes) to comply with technical quotas imposed by the Google API. This delay is purely technical: your publication decision (step 4) is recorded immediately with a timestamp as proof of consent. In the event of repeated technical failure (3 automatic retries), the response is placed in an error queue and you are notified for manual action.

5.7 White-Label (Agency plan)

The "White-Label" feature includes: logo and colour customisation in the Workspace interface, a subdomain of the form agency.localpatron.app, and sender customisation for transactional emails. A "Powered by LocalPatron" mention may appear in the footer of the interface and emails. "100%" refers to coverage of the listed customisable elements, not the complete removal of all references to LocalPatron. The Agency undertakes to include in its own contracts with end clients clauses subjecting them to obligations equivalent to §4 and §5.2 of these Terms (compliance with Google rules, human validation, prohibition of unlawful content). The Agency is jointly and severally liable for publications made from its Workspaces, whether initiated by the Agency or by its end clients via the White-Label interface.

6. Intellectual Property

LocalPatron and its components are the exclusive property of LocalPatron. Your data remains your property. LocalPatron claims no rights over content you choose to publish on Google.

7. Liability

LocalPatron is not liable for Google's decisions regarding deletion or rejection of responses, nor for content the user chooses to publish (each response requires 4-step human validation). LocalPatron's liability is limited to amounts paid during the 12 months preceding the damaging event for Pro, Business and Agency plans; and the 3 months preceding for Free and Starter plans. In any case, maximum liability shall not exceed €2,000 per damaging event. This limitation does not apply in cases of wilful misconduct or gross negligence by LocalPatron. In no event shall LocalPatron be liable for indirect damages, loss of profits, loss of reputation or consequential losses arising from use of the Service.

LocalPatron does not guarantee uninterrupted availability of the Service. The Service may be temporarily unavailable due to maintenance, technical updates, or causes beyond LocalPatron's control (force majeure, third-party provider failures, etc.). LocalPatron shall not be liable for any damages resulting from Service interruptions outside its control.

8. Suspension and Termination

You may cancel your account at any time from settings. Upon cancellation, your data will be retained for 30 days before being permanently deleted, in accordance with the timeframes detailed in the Privacy Policy. LocalPatron may suspend or cancel an account for Terms violations, persistent non-payment, or fraudulent use, after 48h notice (except in emergencies — defined as active fraud, system security attacks, use causing immediate harm to third parties, or serious breach of these Terms).

9. Changes

LocalPatron reserves the right to modify the Service or these Terms at any time. Substantial changes will be notified by email 30 days in advance.

10. Governing Law

These Terms are governed by Spanish law. For any dispute arising from their interpretation or performance, the parties submit to the competent courts under applicable procedural law (judicial district of Torrevieja, Alicante), unless mandatory law provides otherwise. This Service is directed exclusively at professionals (B2B); consumer online dispute resolution regulations do not apply.

12. Personal Data Protection

The processing of users' personal data is governed by LocalPatron's Privacy Policy, available at localpatron.app/en/privacy, which forms an integral part of these Terms. By accepting these Terms, the user acknowledges having read and accepted the Privacy Policy.
